A judge has ordered John Eastman
A judge has ordered John Eastman to send further emails to the Jan. 6 Committee. Eastman, the lawyer who produced papers stating then-Vice President Mike Pence could overturn the 2020 election, was directed to turn over about 170 documents to the panel. Washington— A federal court has ordered John Eastman, the Trump lawyer who created memoranda indicating then-Vice President Mike Pence could overturn the 2020 election, to give over roughly 170 files to the House committee investigating the Jan. 6 attack on the Capitol.
U.S. District Judge David Carter said in a filing Tuesday that while 440 documents are privileged, Eastman has to give the committee 159 other documents by Wednesday afternoon, which include communications from former President Donald Trump about state electors in swing states and the size of his campaign rallies. The judge emphasized one email from Dec. 20, 2020, that he said contains evidence of a potential crime. “This email evaluates whether to initiate a case that would resolve the interpretation of the Electoral Count Act and maybe risk a court judgment that the Act binds Vice President Pence,” the judge wrote.
“Because the attorney judged that a negative court ruling would ‘tank the January 6 strategy,’ he recommended the legal team avoid the courts. This email reaffirmed the direction of the January 6 strategy.” Carter reportedly asked Eastman to also give 10 other documents to the committee that relates to three meetings in the first two weeks of December 2020 hosted by an anonymous entity that favored Trump. “Four documents pertain to a meeting on December 8, 2020: two emails are the group’s high-profile leader inviting Dr. Eastman to speak at the meeting, and two include the meeting’s agenda,” the court stated.

Eastman has attempted to hide discussions and information from the committee, saying that such records are protected by privilege. Carter has been suspicious of many of Eastman’s privilege arguments and has already ordered him to turn over hundreds of pages of files to the committee. Since it was created last year, the committee has questioned over a thousand witnesses, issued roughly 100 subpoenas, and gathered about 140,000 pages of documents pertaining to its probe.
According to the meeting’s agenda, Carter indicated that Eastman discussed “state legislative actions that can reverse the media-called election for Joe Biden.” He added that another person offered an “update on [state] legislature processes about electoral votes.” Five other documents highlighted the schedule for another meeting the next day, on December 9, 2020, which focussed on a “GROUND GAME following Nov 4 Election Results” in which a sitting member of Congress discussed a plan “to challenge the electors in the House of Representatives.” A similar meeting was held on December 16, 2020.
And that meeting’s agenda contained a state elector reviewing “The Constitutional Implications of the Electoral College Meeting and What Comes Next.” The group “had a strong interest in these three meetings as the presentations furthered a critical aim of the January 6 plan: to have contested states certify alternate slates of electors for President Trump,” Carter wrote. “The week before these conversations, Dr. Eastman wrote memoranda to high-level White House employees underlining that the January 6 plan needed legislators ‘to define the mechanism of picking electors, even to the extent of adopting a slate of electors themselves.’”

John Charles Eastman (born April 21, 1960) is an American lawyer who is the founding director of the Center for Constitutional Jurisprudence, a public interest legal practice connected with the conservative think tank Claremont Institute. He is a former professor and dean at the Chapman University School of Law. He ran unsuccessfully as a Republican for California’s 34th congressional district in 1990, and for the office of California Attorney General in 2010. He is a former law clerk to Supreme Court Justice Clarence Thomas.
Eastman engaged in the attempts to nullify the 2020 United States presidential election
During President Donald Trump’s last efforts before the certification of Joe Biden’s Electoral College victory, Eastman falsely told Vice President Mike Pence in an Oval Office meeting on January 5, 2021, that Pence had the constitutional right to refuse the certification. Pence did not accept Eastman’s argument. Eastman reportedly offered Republican senator Mike Lee a six-point plan of action for Pence to toss out the electors from seven states to keep Trump in power, which Lee declined. On January 6, 2021, Eastman made a speech at the White House Trump rally that preceded the 2021 United States Capitol attack.
Eastman subsequently asked Vice President Pence to violate the Electoral Count Act to postpone the certification of the election, via Pence’s legal counsel Greg Jacob, who responded by branding Eastman a “serpent in the ear of the president of the United States”. On January 13, 2021, Eastman retired from the Chapman University faculty after the outcry generated by his having spoken at the Trump event. March 28, 2022, federal judge David Carter ruled Eastman, along with Trump, was likely to have “dishonestly plotted to interrupt the joint session of Congress on Jan. 6, 2021”.
Previously during the presidential campaign, Eastman penned a heated op-ed in August 2020 which mistakenly indicated that then-presumed Democratic nominee for U.S. Vice President Kamala Harris was not an American citizen and consequently not legally qualified for the job. The Washington Post reported on June 15 that the January 6 committee had just acquired correspondence between Eastman and Ginni Thomas, wife of Supreme Court Justice Clarence Thomas.
